1. Purpose

This document describes how law enforcement agencies and government authorities may request information from PlanFolks in connection with official investigations, and the legal standards we apply to such requests. This is a legal reference document for authorities and legal professionals, not a general User-facing policy.

2. Definitions

  • Legal Process — a subpoena, court order, search warrant, or other valid legal instrument compelling disclosure of information.
  • Requesting Agency — a government or law enforcement authority submitting a request.
  • Preservation Request — a request to retain specified account data pending the issuance of formal Legal Process.

3. Information Requests

PlanFolks requires valid Legal Process issued by a court or authority of competent jurisdiction before disclosing User data, except as described in Section 5 (emergency disclosures) or where disclosure is otherwise required or permitted by applicable law.

All requests must:

  1. Be made in writing, on official letterhead, from a verifiable law enforcement or government email address or through official channels.
  2. Identify the specific account(s) or Content at issue (e.g., username, registered email, or account ID).
  3. Specify the legal basis and scope of the request.
  4. Be limited to what is reasonably necessary for the stated investigative purpose.

We review each request for legal sufficiency and reserve the right to challenge requests we believe are overbroad, improperly issued, or inconsistent with applicable law.

4. Types of Information Available

Requirements vary by jurisdiction; we apply the legal standard applicable to the requesting authority's jurisdiction and the nature of the data sought.

5. Emergency Disclosure Requests

Where we have a good-faith belief that there is an imminent risk of death or serious physical harm to a person, we may voluntarily disclose relevant account information to law enforcement without Legal Process, consistent with applicable law (e.g., 18 U.S.C. § 2702(b)(8) in the U.S., or equivalent provisions elsewhere).

To submit an emergency disclosure request:

  1. Email support@planfolks.com with subject line "EMERGENCY DISCLOSURE REQUEST."
  2. Include a description of the emergency, the specific account(s) involved, and your official contact information for verification.

We evaluate emergency requests independently and reserve sole discretion to determine whether the circumstances justify disclosure without Legal Process.

6. Data Preservation Requests

Law enforcement may request that we preserve existing account data pending the issuance of formal Legal Process. Upon a valid preservation request:

  • We will preserve the specified data for an initial period of 90 days, extendable upon request, consistent with standard industry practice (e.g., 18 U.S.C. § 2703(f) in the U.S.).
  • Preservation does not constitute disclosure; separate valid Legal Process is still required to obtain the preserved data, unless an emergency exception applies.

7. Jurisdiction and International Requests

  • PlanFolks is headquartered in [Jurisdiction — to be inserted] and generally requires Legal Process issued by, or domesticated in, that jurisdiction.
  • Requests from foreign authorities should be submitted through applicable Mutual Legal Assistance Treaty ("MLAT") channels or equivalent international cooperation frameworks, unless an emergency disclosure applies.
  • We evaluate international requests on a case-by-case basis, considering applicable law, international comity, and the rights of our Users.

8. User Notification

Consistent with our Privacy Policy, we will notify affected Users of a request for their data prior to disclosure, unless:

  • We are prohibited from doing so by law or a valid non-disclosure order;
  • Notice would jeopardize an active investigation or risk harm to any person (e.g., emergency disclosures, child safety matters); or
  • The request relates to an ongoing violation of our Policies where notice would compromise enforcement.

9. Cost Reimbursement

PlanFolks may seek reimbursement of reasonable costs associated with responding to Legal Process, where permitted by applicable law.
