1. Purpose

This Copyright Policy explains how PlanFolks handles claims of copyright infringement involving User Content on the platform, and the process for reporting infringement, submitting counter-notices, and how we treat repeat infringers. For our formal takedown notice procedure under U.S. law, see our DMCA Policy.

2. Our Commitment

PlanFolks respects the intellectual property rights of others and expects Users to do the same. We do not tolerate the use of the Service to infringe the copyright of any person or entity, in accordance with our Intellectual Property Policy.

3. Reporting Infringement

If you believe that Content on PlanFolks infringes your copyright, submit a written notice to support@planfolks.com including:

  1. Identification of the copyrighted work you claim has been infringed.
  2. Identification of the material you claim is infringing, with enough detail (e.g., a link, username, or screenshot) for us to locate it.
  3. Your contact information (name, address, telephone number, and email address).
  4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  6. Your physical or electronic signature.

4. What Happens After a Report

Upon receiving a valid infringement notice, we will:

  1. Review the notice for completeness and validity.
  2. Remove or disable access to the identified material, where the claim is valid on its face.
  3. Notify the User who posted the material of the removal and provide a copy of the notice, except where prohibited by law.
  4. Document the report for repeat-infringer tracking purposes (see Section 6).

5. Counter-Notice

If you believe your Content was removed in error or as a result of misidentification, you may submit a counter-notice to support@planfolks.com including:

  1. Identification of the material removed and its location before removal.
  2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the relevant courts.
  4. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we may restore the material within a reasonable time, unless the original complainant informs us that they have filed a legal action seeking a court order to restrain the User from engaging in infringing activity.

6. Repeat Infringers

Consistent with applicable law, PlanFolks maintains a policy of terminating, in appropriate circumstances, the accounts of Users who are determined to be repeat infringers. We track validated infringement notices against each account and will suspend or permanently terminate accounts with multiple substantiated claims.

7. False Claims

Submitting a knowingly false infringement notice or counter-notice may result in legal liability for damages, including costs and attorneys' fees. Please ensure your claim is accurate and made in good faith before submission.
