1. Acceptance of Terms

These Terms and Conditions ("Terms") form a binding legal agreement between you ("User," "you") and PlanFolks ("PlanFolks," "we," "us," "our") governing your access to and use of the PlanFolks mobile application and website at https://planfolks.com (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, Community Guidelines, and all other policies referenced herein (collectively, the "Policies"). If you do not agree, you must not use the Service.

4. Account Registration

• You must register using accurate, current, and complete information via Email OTP, Google Sign-In, or Apple Sign-In.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• One individual may maintain only one active account, unless we authorize otherwise in writing.
• You must promptly notify us at support@planfolks.com of any unauthorized use of your account.
• Impersonation of any person or entity, or misrepresentation of your identity, age, or affiliation, is strictly prohibited.

5. User Responsibilities

As a condition of using PlanFolks, you agree to:

1. Provide truthful and accurate profile information.
2. Use the Service only for lawful purposes consistent with its intended function as a travel companionship and community platform.
3. Treat other Users with respect, in accordance with our Community Guidelines.
4. Exercise personal judgment and caution when meeting other Users, in accordance with our Safety Guidelines. PlanFolks does not conduct background checks on Users and is not responsible for the conduct of any User, online or offline.
5. Comply with all applicable local, national, and international laws while using the Service, including while traveling.

6. Acceptable Behavior

Users are expected to engage constructively with the PlanFolks community, including:

• Communicating respectfully in chats, comments, and shared travel plans.
• Providing honest information in travel plans (dates, destinations, costs, and group size).
• Reporting suspicious, abusive, or unsafe behavior promptly using in-app reporting tools.
• Respecting the privacy and personal boundaries of other Users.

7. Prohibited Activities

You may not use PlanFolks to:

1. Harass, threaten, stalk, defame, or abuse another User.
2. Post or transmit hate speech, discriminatory content, or content promoting violence.
3. Create fake profiles, impersonate others, or engage in "catfishing."
4. Solicit money, gifts, or financial information from other Users, or engage in any scam, fraud, or pyramid scheme.
5. Post spam, unsolicited advertising, or promote unrelated third-party products or services.
6. Share sexually explicit content, solicit sexual services, or engage in any form of sexual exploitation.
7. Post or facilitate illegal activity, including the sale of controlled substances, weapons, or stolen goods.
8. Upload content that infringes the intellectual property rights of any third party.
9. Reverse-engineer, scrape, or use automated means to access the Service without our prior written consent.
10. Circumvent, disable, or interfere with security features of the Service.
11. Use the Service if you are a registered sex offender or have been convicted of a violent crime that would pose a risk to other Users.

8. User-Generated Content

You retain ownership of Content you submit to PlanFolks. By submitting Content, you grant PlanFolks a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting purposes), publish, and display such Content solely for the purpose of operating, promoting, and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to the Content you submit.
• Your Content does not infringe any third party's intellectual property, privacy, or other rights.
• Your Content complies with our Content Policy and Community Guidelines.

We reserve the right, but not the obligation, to review, moderate, or remove any Content that violates these Terms or our Policies, at our sole discretion and without prior notice.

9. Intellectual Property

The Service, including its software, design, logos, trademarks, and underlying technology, is owned by PlanFolks and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal, non-commercial purpose.

10. Premium Subscriptions

PlanFolks may, at its discretion, offer optional premium subscription plans providing enhanced features ("Premium Subscriptions"). Premium Subscriptions, when introduced, will be:

• Billed through the Google Play Store or Apple App Store, as applicable, or through third-party payment processors (Stripe, Razorpay) for web-based purchases.
• Subject to the pricing, billing cycle, and auto-renewal terms disclosed at the time of purchase.
• Governed by our Refund and Cancellation Policy.

11. Payments

Where payment features are enabled:

1. All fees are displayed in the applicable currency prior to purchase.
2. Payments are processed by Google Play, Apple App Store, Stripe, or Razorpay, and are subject to their respective terms of service.
3. You authorize us (via our payment processors) to charge your selected payment method for all fees incurred.
4. Prices may change with prior notice; changes will not affect subscriptions already in their current billing cycle.

12. Refunds

Refunds, where applicable, are handled according to our Refund and Cancellation Policy and the refund policies of the applicable app store or payment processor.

13. Suspension

We may suspend your account or restrict access to certain features, with or without prior notice, if we reasonably believe:

• You have violated these Terms or any referenced Policy;
• Your conduct poses a risk to the safety of other Users or the integrity of the Service;
• We are required to do so by law or in response to a valid legal request;
• Your account is associated with fraudulent, abusive, or suspicious activity.

Suspension may be temporary or may precede termination pending investigation.

14. Termination

• By You: You may terminate your account at any time by following the process in our Account Deletion Policy.
• By Us: We may terminate or suspend your account, with or without cause, including for violations of these Terms, at our sole discretion. PlanFolks is a platform that facilitates connections between travelers. We do not verify the identity, background, or intentions of Users, and we are not responsible for the conduct of any User, whether online or during in-person meetings or travel arranged through the Service. You use the Service, and interact with other Users, entirely at your own risk. Review our Safety Guidelines before meeting other Users or traveling with them.

To the maximum extent permitted by law, PlanFolks and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service or interactions with other Users. Our aggregate liability for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) [INR 5,000 / USD 100 — to be finalized].
